Terms of use of the Horgen swimming channel

for the use of the private mobile swimming channel of Roy Hinnen/FlussPool GmbH

   
  1. Scope of application
These terms of use apply to all persons using the private mobile swimming channel of FlussPool GmbH. By booking a time slot at www.schwimmkanal.ch, the user acknowledges these terms of use.  
  1. Right of use
Only athletes trained by Roy Hinnen are permitted to use the swimming channel. Access is only granted at the agreed times. Access is not open to the public and can be refused without justification. Payment in cash or TWINT on site. Cancellations up to 21 days before the date are free of charge, after that the entire fee is due and the coaching can be made up at a later date “free of charge” with a new booking.
  1. State of health
Use of the swimming channel is at your own risk. Persons with infectious diseases and open wounds are prohibited from using the swimming channel. The user assures that they are in good health to use the swimming channel.      
  1. House and bathing rules
The instructions of the operator must be followed. It is mandatory to shower before swimming. Paddles, fins and other swimming accessories may not be used while swimming (equipment/turbines could be damaged). Glass containers and similar materials that could cause shards are prohibited in the entire pool area.      
  1. Liability
Use of the swimming channel is at your own risk. The operator accepts no liability for accidents, injuries or damage to health. No liability is accepted for items brought along, in particular valuables.
  1. Damage and contamination
Any damage caused to the swimming channel must be reported immediately. The user is liable to FlussPool GmbH for damage caused by improper use, including claims for compensation due to lost hours, including those of third parties. If the user is responsible for a total loss or other destruction of the object of the contract, he must compensate the replacement value of the swimming channel. The user is obliged to inform FlussPool GmbH immediately if damage has occurred or if there is a risk that damage may occur (e.g. also if a swimming cap or swimming goggles have fallen into the water. In the event of gross contamination of the swimming channel, cleaning costs may be charged.  
  1. Video surveillance
The swimming channel is under 24-hour video surveillance. The user agrees that videos can be distributed in the media, including social media.  
  1. Data protection
Personal data is used exclusively for the organization and processing of the use of the swimming channel and is not passed on to third parties.  
  1. Final provisions
The place of jurisdiction is the registered office of FlussPool GmbH. Swiss law is applicable.
